Executive Summary

Investigators are trained to develop facts, but they cannot responsibly answer every scientific, medical, technical, financial, or digital question. Recognizing when ordinary investigative work has reached a specialized boundary is part of professional judgment. This publication explains how a defense team defines the technical issue, assesses its materiality, preserves the necessary evidence, and gives an expert a neutral assignment.

The decision to seek expert assistance should begin with a specific technical question, not simply with the fact that the government used an expert. Specialized review is most valuable when the issue could materially affect identity, causation, timing, authenticity, injury, or another disputed fact. Original data, records, photographs, physical evidence, measurements, and chain-of-custody information should be preserved so the expert can perform a meaningful independent analysis.

Knowing when an investigative question has become a technical question is part of professional judgment.

Who Should Read This Publication?

  1. Military defense counsel deciding whether specialized assistance is necessary
  2. Defense investigators who encounter technical questions beyond ordinary investigative methods
  3. Service members whose cases involve disputed forensic, medical, digital, financial, or scientific evidence
  4. Experts receiving materials or assignments from a defense team
  5. Families trying to understand why specialized review may be important
